- A pending I-485, application to Register Permanent Residence or Adjust Status
- A pending I-589, Application for Asylum and for Withholding of Removal
- You have a non-immigrant visa (such as F-1 or M-1 student)
You do not need to apply for an EAD if you are a Lawful Permanent Resident. Your Green Card is evidence of your employment authorization. You also do not need an EAD if you have a non-immigrant visa that authorizes you to work for a specific employer such as an H-1B, L-1B, O or P visa.
Employment Cards are valid for 1 year. In some case, asylees will receive an EAD valid for 2 years as well as DACA applicants. Renewal of your EAD generally takes 90 – 120 days from the receipt of the application by USCIS.
